Imation warrants that this Imation CD-ROM DISC is free from defects in material and manufacture at the time of purchase.

If any defect in material or manufacture appears within twenty-five (25) years from the date of purchase, Imation's entire liability, and your exclusive remedy is, at Imation's option, either (a) repair, or (b) replacement of the Disc, or (c) refund of the purchase price of the Disc, which is returned to Imation with proof of purchase (P.O. or invoice).

This warranty does not apply to failure of the Disc resulting from misuse, abuse, accident, neglect or mishandling, improperly adjusted or maintained drives, incorrect environments, or wear from ordinary use.

THIS WARRANTY IS MADE IN LIEU OF ALL OTHER RIGHTS, CONDITIONS AND WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Imation AND SELLER SHALL NOT BE LIABLE UNDER ANY LEGAL THEORY (INCLUDING TORT OR CONTRACT) FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGE (INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST PROFITS, LOST SAVINGS OR LOST DATA) IN ANY WAY RELATED TO THE DISC. THIS LIMITATION DOES NOT APPLY TO CLAIMS FOR PERSONAL INJURY.
